The following sale and agreement are made and entered into by and between the following parties and is effective this the ____ day of _____, _____.
1. NAMES: Melissa Alley, (hereinafter “Seller”), and ___________________ (hereinafter “Buyer”) agree to the following terms in the sale and purchase of one _________ English Cream Golden Retriever (hereinafter “Puppy”).
2. PURCHASE PRICE. The purchase price is $2500.00 and shall be paid in full (checks cleared through the bank, or cash on day of release) prior to release of the Puppy to Buyer and/or before travel arrangements are made.
3. DEPOSIT. Buyer agrees to pay, and Seller hereby accepts, a non-refundable (with exception that requested sex is not available or pregnancy fails) deposit of $500.00, which shall be paid concurrently with the execution of this Purchase Agreement and shall be applied towards the purchase price of the Puppy. Seller shall not hold a puppy for Buyer until said deposit has been received. Litter DOB 10/8/2022
4. SHIPPING EXPENSES. Seller does not ship puppies in cargo. However, out-of-state new puppy owners are encouraged to travel by air with their puppy as a companion under the seat with them. This ensures the Puppy is always in custody of new puppy parents during travel. Under rare occasions, and additional expense, Seller can deliver a puppy personally to his / her destination.
5. FIRST RIGHT OF REFUSAL. If, for any reason Buyer is unable to keep the Puppy at any time over the life span of the Puppy, Seller will have first right to take the Puppy back. The Puppy shall not be surrendered to a shelter or rescue under any circumstances. All expenses associated with the transport and delivery of puppy to Seller will be the responsibility of the Buyer. Under these circumstances, no refund will be offered.
6. 12 MONTH HEALTH GUARANTEE ON HIPS, ELBOWS, EYES AND HEART. In the event of a genetic defect not due to injury or environmental factors, Buyer shall provide a statement from a veterinarian confirming the genetic defect. Seller will get a second opinion from a veterinarian of Seller’s choice. A replacement puppy will be provided. No full or partial monetary refunds will be given. The Seller is not responsible for any veterinarian cost before or after the defect was established. Since 82% of all hip dysplasia is due to overfeeding or feeding high protein, high calorie diet, Puppy must be kept in trim weight, especially avoiding obesity, and closely approximate Target Weights as verifiable through veterinary records. Puppy will not be neutered or spayed until full bone growth has been achieved at 18 months.
7. RESPONSIBILITIES OF THE BUYER. Certain activities can cause joint or other health problems. To avoid these problems, Buyer agrees to the following terms. Buyer must have Puppy examined by a veterinarian within 72 hours of receipt of Puppy.
Buyer will maintain Puppy’s weight at an appropriate level for the Puppy’s build and height. At no time is the Buyer to permit Puppy to become overweight or obese.
Puppy will not be permitted to jump higher than Puppy’s elbow height during the first 12 months of Puppy’s life.
Puppy will be fed with a high-quality dog food or raw diet that promotes healthy bone and joint development. Grain free food is unacceptable as current research shows it can cause dilated cardiomyopathy – a heart disease that can cause sudden death in dogs.
Puppy will have annual veterinary checkups with appropriate vaccinations and monthly administration of heartworm preventative.
Upon purchase of Puppy, Buyer will receive a folder with information about the Puppy. Included in this folder is current vaccinations and worming schedule. Puppies are found to be in good health and free from visible signs of infection, contagious or communicable diseases when purchased. Seller is not responsible if puppy contracts a communicable disease after leaving Seller's possession.
All veterinarian fees and expenses after the sale, shall be the responsibility of the Buyer. Under no circumstances shall the Seller be held responsible for any expenses for any puppy not in the possession of the Seller.
Note: When you pick the Puppy you want, it’s best to have the family help in the decision because it will become a family dog by its nature. Like people and children, each puppy has its own distinct look and personality.
8. MEDIATION. If a dispute arises relating to this Purchase Agreement (whether prior to or after delivery of Puppy) and is not resolved, the parties must first proceed, in good faith, to mediation. Mediation is a process in which the parties meet with an impartial person who helps to resolve the dispute informally and confidentially. Mediators cannot impose binding decisions. Before any mediated settlement is binding, the parties to the dispute must agree to the settlement, in writing. The parties will jointly appoint an acceptable mediator and will share equally in the cost of such mediation. The obligation to mediate, unless otherwise agreed, will terminate if the entire dispute is not resolved within thirty days of the date written notice requesting mediation is delivered by one party to the other at that party’s last known address. Nothing prohibits either party from filing a lawsuit, before or after the date of written notice requesting mediation. In such event, the prevailing party will be entitled to an award of court costs and attorney’s fees.

The parties have read this Purchase Agreement in full and hereby accept and agree to all terms contained in this Agreement and further acknowledge receipt of a copy of this Agreement.
